Rocket Software Additional Licensing Terms for Generative AI

THE FOLLOWING TERMS APPLY TO ROCKET SOFTWARE GENAI-BASED OFFERINGS:

Esta oferta de Rocket Software incorpora un sistema automatizado basado en inteligencia artificial generativa ("GenAI"), proporcionado por Rocket Software o adquirido por su organización ("Cliente") y configurado para funcionar con la oferta de Rocket Software (la "Oferta de IA de Rocket "). Debe usar e interactuar con cualquier modelo GenAI de terceros incorporado a la Oferta de IA de Rocket de forma responsable y legal.

All use of the Rocket AI Offering must be in accordance with Customer’s applicable access and acceptable use as well as artificial intelligence policies and controls and the following licensing terms and usage conditions:

Using GenAI Content

You agree that you will use the Rocket AI Offering for Customer’s legitimate business purposes and not use or allow the Rocket AI Offering to be used for any dangerous, illegal, or malicious activities or content, including:

• abusive or illegal content (including text, images, video, audio, or code) or data, or content or data that is false, misleading, disparaging, or violates the rights of others;
• legal, medical, financial, or other kinds of professional advice, including any opinions, judgments, or recommendations;
• fully automated decision making in connection with use cases involving critical processes or the risk of loss of life, property or impact on an individual’s legal rights;
• in a way that impersonates another for deceptive purposes or conceals the fact a user is interacting with artificial intelligence;  
• in a way that attempts to override or circumvent safety filters or intentionally drive the model to act in a manner that contravenes these terms; or
• to make automated decisions in domains that affect material or individual rights or well-being (e.g., finance, legal, employment, healthcare, housing, insurance, and social welfare).

Ensuring fairness and transparency

Al utilizar la Oferta de IA de Rocket, usted se compromete a garantizar la precisión y fiabilidad de los resultados o la información generada por la Rocket . Esto puede consistir en verificar los resultados con criterios de verosimilitud y razonabilidad, o en contrastar los resultados con datos conocidos, así como en utilizar diversas fuentes independientes y fiables para verificar la información.

Inputs and Outputs

Input. Customer and you are solely responsible for Input. Rocket Software may automatically block Input, in its sole discretion, if Rocket Software believes Input violates this Agreement.  Customer owns all Input unless it incorporates Rocket-owned data or intellectual property.  “Input” means any applicable content or information input or imported to the Rocket AI Offering by Customer, including but not limited to an audio file, video file, document, code, data, image, text, or a combination of the foregoing.

Output. Customer and you are solely responsible for the use of Output and for ensuring such use of Output complies with these terms and applicable laws and regulations. Output may sometimes be inaccurate, misleading, or include material that may belong to others. Rocket may use third-party technologies, vendors, or processes to screen for and block Output that may violate applicable law or regulation, the rights of a third party, or the Agreement, before Output is provided to you or Customer. Output is owned by Rocket Software unless an applicable Additional License Authorization or other agreement between the parties specifies otherwise. To the extent any Customer-owned data is incorporated into the Output, the Customer-owned data remains owned by Customer and is licensed to Rocket Software for use as set forth herein with respect to Permitted Use of Output.  In some cases, Output may not be protectable by intellectual property rights. “Output” means any applicable output provided to you or Customer that is generated by the Rocket AI Offering based on Input, including but not limited to text, text effects, image, vector graphic, audio file, texture, video file, data, or code. Output does not include any references to or summaries of Rocket Software product documentation.  

Warranties; Disclaimer

Rocket Software renuncia a toda garantía, expresa o implícita, con respecto a cualquier modelo de IA (incluido cualquier modelo de IA configurado o seleccionado por usted o el Cliente) y cualquier Resultado, incluyendo cualquier garantía implícita de que el Resultado no infringirá los derechos de terceros ni ninguna ley o normativa aplicable. No utilizará, ni permitirá que terceros bajo el control del Cliente, la Oferta de IA de Rocket ni el Resultado para crear, construir, desarrollar, entrenar, probar o mejorar, directa o indirectamente, algoritmos de aprendizaje automático o sistemas de inteligencia artificial, incluidas arquitecturas, modelos o ponderaciones. Si corresponde, al seleccionar su propio modelo de IA, usted reconoce y acepta que es el único responsable de la selección, configuración y gestión de dicho modelo de IA y de los riesgos asociados, así como de cualquier Información que usted o el Cliente proporcionen.

Permitted Use  

Rocket Software and its affiliates may process, use, copy, transmit, aggregate, model, index, store, and display Input and Output (a) to perform its obligations under the Agreement, including support and operation of the Rocket AI Offering and other Products and Services; and (b) for product improvement, customization, development, or research.

Data Protection  

El Cliente debe proteger cualquier información personal o confidencial generada o utilizada por herramientas de IA generativa de acuerdo con sus políticas de protección de datos y las leyes y normativas aplicables. El Cliente no debe utilizar la Oferta de IA Rocket para generar o procesar datos sensibles, como historiales médicos, datos financieros o información personal identificable, sin la debida autorización y las medidas de seguridad establecidas.

Non-Compliance  

El incumplimiento de esta política puede resultar en la cancelación del acceso a la Oferta de IA de Rocket o del acuerdo contractual subyacente. Cualquier incumplimiento de estos términos debe informarse a la autoridad competente, como su gerente o el departamento de TI del Cliente, así como a Rocket Software.
