This Rocket Software offering incorporates an automated, generative artificial intelligence (“GenAI”) - based system that is either provided by Rocket Software or procured by your organization (“Customer”) and configured to work with the Rocket Software offering (the “Rocket AI Offering”). You must use and interact with any third party GenAI model incorporated into the Rocket AI Offering responsibly and lawfully.
All use of the Rocket AI Offering must be in accordance with Customer’s applicable access and acceptable use as well as artificial intelligence policies and controls and the following licensing terms and usage conditions:
You agree that you will use the Rocket AI Offering for Customer’s legitimate business purposes and not use or allow the Rocket AI Offering to be used for any dangerous, illegal, or malicious activities or content, including:
When using the Rocket AI Offering you agree to ensure the accuracy and reliability of the Output or information results generated by the Rocket AI Offering. This can consist of verifying the information results against plausibility and reasonableness criteria or testing the Output against known data as well as using multiple independent and trustworthy sources to verify information.
Input. Customer and you are solely responsible for Input. Rocket Software may automatically block Input, in its sole discretion, if Rocket Software believes Input violates this Agreement. Customer owns all Input unless it incorporates Rocket-owned data or intellectual property. “Input” means any applicable content or information input or imported to the Rocket AI Offering by Customer, including but not limited to an audio file, video file, document, code, data, image, text, or a combination of the foregoing.
Output. Customer and you are solely responsible for the use of Output and for ensuring such use of Output complies with these terms and applicable laws and regulations. Output may sometimes be inaccurate, misleading, or include material that may belong to others. Rocket may use third-party technologies, vendors, or processes to screen for and block Output that may violate applicable law or regulation, the rights of a third party, or the Agreement, before Output is provided to you or Customer. Output is owned by Rocket Software unless an applicable Additional License Authorization or other agreement between the parties specifies otherwise. To the extent any Customer-owned data is incorporated into the Output, the Customer-owned data remains owned by Customer and is licensed to Rocket Software for use as set forth herein with respect to Permitted Use of Output. In some cases, Output may not be protectable by intellectual property rights. “Output” means any applicable output provided to you or Customer that is generated by the Rocket AI Offering based on Input, including but not limited to text, text effects, image, vector graphic, audio file, texture, video file, data, or code. Output does not include any references to or summaries of Rocket Software product documentation.
Rocket Software disclaims all warranties, express or implied, regarding any AI models (including any AI model configured or selected by you or Customer) and any Output, including any implied warranties that Output will not violate the rights of a third party or any applicable law or regulation. You will not, and will not allow third parties under Customer’s control to, use the Rocket AI Offering or Output to directly or indirectly create, build, develop, train, test, or otherwise improve any machine learning algorithms or artificial intelligence systems, including any architectures, models, or weights. If applicable, when selecting your own AI model you acknowledge and agree that you are solely responsible for selecting, configuring and managing that AI model and any associated risks as well as for any Input that you or Customer provide.
Rocket Software and its affiliates may process, use, copy, transmit, aggregate, model, index, store, and display Input and Output (a) to perform its obligations under the Agreement, including support and operation of the Rocket AI Offering and other Products and Services; and (b) for product improvement, customization, development, or research.
Customer must protect any personal or confidential information generated or used by generative AI tools in accordance with its data protection policies and relevant laws and regulations. Customer should not use the Rocket AI Offering to generate or process sensitive data, such as health records, financial data, or personally identifiable information, without the proper authorization and security measures in place.
Non-compliance with this policy may result in termination of access to the Rocket AI Offering or the underlying contractual agreement. Any violations of these terms should be reported to the appropriate authority, such as your manager or the IT department of Customer, as well as to Rocket Software.
