Rocket Software Additional Licensing Terms for Generative AI

THE FOLLOWING TERMS APPLY TO ROCKET SOFTWARE GENAI-BASED OFFERINGS:

Cette offre de Rocket Software intègre un système automatisé d'intelligence artificielle générative (« GenAI ») fourni par Rocket Software ou acquis par votre organisation (« Client ») et configuré pour fonctionner avec l'offre de Rocket Software (l'« Offre d'IA de Rocket »). Vous devez utiliser et interagir avec tout modèle GenAI tiers intégré à l'Offre d'IA de Rocket de manière responsable et légale.

All use of the Rocket AI Offering must be in accordance with Customer’s applicable access and acceptable use as well as artificial intelligence policies and controls and the following licensing terms and usage conditions:

 

Using GenAI Content

You agree that you will use the Rocket AI Offering for Customer’s legitimate business purposes and not use or allow the Rocket AI Offering to be used for any dangerous, illegal, or malicious activities or content, including:

  • abusive or illegal content (including text, images, video, audio, or code) or data, or content or data that is false, misleading, disparaging, or violates the rights of others;
  • legal, medical, financial, or other kinds of professional advice, including any opinions, judgments, or recommendations;
  • fully automated decision making in connection with use cases involving critical processes or the risk of loss of life, property or impact on an individual’s legal rights;
  • in a way that impersonates another for deceptive purposes or conceals the fact a user is interacting with artificial intelligence;  
  • in a way that attempts to override or circumvent safety filters or intentionally drive the model to act in a manner that contravenes these terms; or
  • to make automated decisions in domains that affect material or individual rights or well-being (e.g., finance, legal, employment, healthcare, housing, insurance, and social welfare).

 

Ensuring fairness and transparency

Inputs and Outputs

Input. Customer and you are solely responsible for Input. Rocket Software may automatically block Input, in its sole discretion, if Rocket Software believes Input violates this Agreement.  Customer owns all Input unless it incorporates Rocket-owned data or intellectual property.  “Input” means any applicable content or information input or imported to the Rocket AI Offering by Customer, including but not limited to an audio file, video file, document, code, data, image, text, or a combination of the foregoing.

Output. Customer and you are solely responsible for the use of Output and for ensuring such use of Output complies with these terms and applicable laws and regulations. Output may sometimes be inaccurate, misleading, or include material that may belong to others. Rocket may use third-party technologies, vendors, or processes to screen for and block Output that may violate applicable law or regulation, the rights of a third party, or the Agreement, before Output is provided to you or Customer. Output is owned by Rocket Software unless an applicable Additional License Authorization or other agreement between the parties specifies otherwise. To the extent any Customer-owned data is incorporated into the Output, the Customer-owned data remains owned by Customer and is licensed to Rocket Software for use as set forth herein with respect to Permitted Use of Output.  In some cases, Output may not be protectable by intellectual property rights. “Output” means any applicable output provided to you or Customer that is generated by the Rocket AI Offering based on Input, including but not limited to text, text effects, image, vector graphic, audio file, texture, video file, data, or code. Output does not include any references to or summaries of Rocket Software product documentation.  

 

Warranties; Disclaimer

Rocket Software décline toute garantie, expresse ou implicite, concernant les modèles d'IA (y compris tout modèle d'IA configuré ou sélectionné par vous ou le Client) et les résultats obtenus, notamment toute garantie implicite que ces résultats ne violeront pas les droits de tiers ni aucune loi ou réglementation applicable. Vous vous engagez à ne pas utiliser, ni à autoriser des tiers sous votre contrôle, l'offre d'IA de Rocket ou les résultats obtenus pour créer, développer, entraîner, tester ou améliorer, directement ou indirectement, des algorithmes d'apprentissage automatique ou des systèmes d'intelligence artificielle, y compris leurs architectures, modèles ou pondérations. Le cas échéant, lors du choix de votre propre modèle d'IA, vous reconnaissez et acceptez être seul responsable de sa sélection, de sa configuration et de sa gestion, ainsi que des risques associés et des données d'entrée fournies par vous ou le Client.

 

Permitted Use  

Rocket Software and its affiliates may process, use, copy, transmit, aggregate, model, index, store, and display Input and Output (a) to perform its obligations under the Agreement, including support and operation of the Rocket AI Offering and other Products and Services; and (b) for product improvement, customization, development, or research.

 

Data Protection  

Le client doit protéger les informations personnelles ou confidentielles générées ou utilisées par les outils d'IA générative conformément à sa politique de protection des données et à la réglementation en vigueur. Il lui est interdit d'utiliser l'offre Rocket AI pour générer ou traiter des données sensibles, telles que des dossiers médicaux, des données financières ou des informations permettant d'identifier une personne, sans autorisation et mesures de sécurité appropriées.

 

Non-Compliance  

Le non-respect de cette politique peut entraîner la résiliation de l'accès à l'offre Rocket AI ou du contrat sous-jacent. Toute violation de ces conditions doit être signalée à l'autorité compétente, telle que votre responsable ou le service informatique du client, ainsi qu'à Rocket Software.
